Child Prisoners

․ The imprisonment of Palestinian children is a common feature of Israel's occupation of the West Bank.
        ․ Defence for Children International (DCI) estimates that since 2000 around 7,500 Palestinian children have been prosecuted by Israeli military courts.
․ Many expected the 164 children (aged 12-17) being held by Israel to be among the 1,000+ Palestinians released in exchange for Gilad Shalit; they weren't. Most (62%) have been detained for "stone throwing".
․ A majority of the children arrested originate from the West Bank and East Jerusalem, with most held at the Hasharon Prison.
․ The ill-treatment of the child often begins at the moment of arrest, which often happens in a night time raid, with the child being removed from the family home with no knowledge of where they are going; the families are not told.
․ The child is questioned at an interrogation centre, alone and without access to family or legal representation.
․ Interrogation continues to be particularly arduous with threats of intimidation and physical violence; "confessions" are given to the child to sign. Many of these "confessions" are written in Hebrew, which few Palestinian children can read.
․ The majority of Palestinian children detained by the Israeli authorities are held in Israel in contravention of Article 76 of the Fourth Geneva Convention which forbids the transfer of prisoners from the occupied territories.
․ The prisons and detention centres where Palestinian children are held often fail to meet the international standards of children's rights and more generally the rights of prisoners.
․ The detention facilities are particularly overcrowded, sometimes with little ventilation and reports of poor hygiene and insect infestation.
․ Reports have claimed that the children also face a lack of adequate food, drink and medical attention.
․ Reports of physical, verbal and, on occasion, sexual abuse of Palestinian children have surfaced. From their arrest the children are intimidated by threats of and actual abuse.
․ During detention children are often exposed to sleep deprivation, extreme heat or cold, and denial of access to toilets and washing facilities.
․ The Public Committee against Torture reported that, "Out of a sample of 100 sworn affidavits collected by lawyers from these children in 2009, 69% of the children reported being beaten and kicked, 49% reported being threatened, 14% were held in solitary confinement, 12% were threatened with sexual abuse including rape and 32% were forced to sign confessions in Hebrew."
․ All Palestinian children are "tried" by military courts in the occupied West Bank, which do not have any obligation to follow Israeli legal requirements, let alone international legal obligations.
․ During military trials, the court proceedings are overseen by Israeli occupation forces but are not recorded.
․ Israeli military courts generally regard Palestinians as minors from 12 to 16; in Israel a child is a minor until aged 18. Following increasing international pressure, notably from British parliamentarians as well as the British government, the Israeli military has agreed to recognise minors as individuals under the age of 18.
․ Access to legal representation is minimal and often families struggle to obtain knowledge of where their child is being held, with visit permits being hard to obtain.
․ Lawyers often advise children to plead guilty as this can often lead to release after 3 months detention; a plea of innocence can see children held for up to a year.
        ․ It is estimated that 81% of Palestinian children have confessed during interrogation; these "confessions" are then used during the military trials.
․ Whilst in detention the children are deprived of their right to education.
․ A study by Save the Children estimated that the average length of child detention is 147 days.
․ Save the Children also reported that 90% of children went on to suffer from psychological trauma and stress post-imprisonment.


Recommendations

Defence for Children International, Palestine Section made the following calls on Israel to...
․ Ensure that no child is interrogated in the absence of a lawyer of their choice and family member;
․        Ensure that all interrogations of children are video recorded;
․ Ensure that all evidence suspected of being obtained through ill-treatment or torture be rejected by the military courts;
․ Ensure that all credible allegations of ill-treatment and torture be thoroughly and impartially investigated; and that
․ Those found responsible for such abuse should be brought to justice.
․ "No Palestinian child should be detained inside Israel in contravention of Article 76 of the Fourth Geneva Convention."
․ The Israeli human rights organization  B'Tselem issued the following recommendations:
․ Set the age of minority in the military legislation to conform with the age of minority in Israel and the rest of the world immediately;
․ Prohibit night arrests of minors;
․ Restrict interrogation to daytime hours, with parents present, and give the minors the opportunity to consult with an attorney in an orderly manner that respects the minor's rights;
․ Prohibit the imprisonment of minors under the age of 14;
․ Promote alternatives to detention and find solutions offering alternatives to imprisonment;
․ Establish educational programmes in all prisons and offer study opportunities in all subjects to minimise the harm to minors' studies while they are detained and imprisoned; and
․ Facilitate the issuing of permits to visit minors who are detained and imprisoned.
․ Whilst the 164 children remain detained by the Israeli authorities there are continuous and growing calls for their release and an end to aggressive arrests, military trials and unnecessary detention as a practice of ation forces in the West Bank, as well for Israel's policies and practices in this respect to have regard for the Convention on the Rights of the Child.

The Wall
․ The Wall is not being built on, or in most cases near the 1967 Green Line, but rather cuts deep into the West Bank, expanding Israel's theft of Palestinian land and resources. In total, 85% of the Wall is located in the West Bank.
․ When completed, the Wall and its associated regime will de facto annex some 46% of the West Bank, isolating communities into Bantustans, ghettos and military zones¢Ó
․ This means that the Palestinian population in the West Bank and Gaza Strip, including almost 1.5 million refugees, will be encircled on only 12% of mandate Palestine.
․ Some 12% of Palestinians in the West Bank will be living in the closed military zone of the Jordan Valley or surrounded on three or four sides by the Wall or isolated between it and the green line. They face increasingly unbearable living conditions - the loss of land, markets, movement and livelihoods - and many will face expulsion.
․ This includes over 200,000 Palestinians of East Jerusalem, who will be totally isolated from the rest of the West Bank. 98% of the settler population will be included in the de facto annexed areas.
․ The Wall is not a new idea - since 1994 the Gaza Strip has been surrounded by a barrier that cuts off Palestinians there from the rest of the world.

Movement and Access in the West Bank

According to Office for the Coordination of Humanitarian Affairs - UN in the Occupied Palestinian Territory of September 2011:
․ 522 roadblocks and checkpoints obstruct Palestinian movement in the West Bank, compared to 503 in July 2010.
․ So far in 2011, an additional 495 ad-hoc 'flying' checkpoints obstructed movement around the West Bank each month (on average), compared to 351 in the past two years.
․ 200,000 people from 70 villages are forced to use detours between two to five times longer than the direct route to their closest city due to movement restrictions.
․ One or more of the main entrances are blocked to Palestinian traffic in ten out of eleven major West Bank cities.
․ Palestinians holding West Bank IDs require entry permits to enter East Jerusalem and are limited to using four of the 16 checkpoints along the Barrier.
․ 62 percent of the Barrier is completed, with 80 percent of the Barrier route built inside the West Bank, with highly limited access to areas behind the Barrier.
․ Four of the five roads into the Jordan Valley are not accessible to most Palestinian vehicles.
․ Almost 80 percent of land in the Jordan Valley is off-limits to Palestinians, with the land designated for Israeli settlements, 'firing zones' and 'nature reserves'.
․ 122 closure obstacles shut off the Old City of Hebron from the rest of the city.
․ Palestinian access to their private land around 55 Israeli settlements is highly restricted.

․ Palestinian Christians in East Jerusalem, the West Bank and the Gaza Strip belong to fifteen different denominations, the largest of which are the Greek Orthodox (51 percent), and the Roman Catholics (32 per cent.)
․ Some smaller denominations, such as the Copts who are originally from Egypt, do not number more than a score of families. Yet each denomination or community maintains a rich tradition of rites and rituals, beside educational and other institutions, that speaks of its long presence and attachment to the land called holy.
․ Christians in the West Bank and Gaza Strip actively participated in the 1987 Intifada; some became martyrs, others were imprisoned and still others had to hide from Israeli pursuit.
․ Christian communities reacted collectively as they pressed, like other Palestinians, for an end of occupation and for a new relationship with the Israelis based on mutual respect and recognition of rights.
․ This tradition of good Christian-Moslem relations has evolved through centuries of coexistence and exchange in the cities of Jerusalem, Nazareth, Bethlehem, Ramallah and in the rural areas such as Zababdeh, BirZeit and other towns and villages where Moslems and Christians live side by side and interact in their pursuit of daily pre-occupations and concerns.
․ A number of factors have historically contributed to this tradition of excellent Moslem-Christian relations:4
1-        the modem history of Palestine with the Arab-Israeli conflict affecting the entire population equally, with the experience of dispersal and loss of homeland.
2-        the contribution which Christian institutions, mostly Western, have made since the 19th century to the education, health and other needs of the population irrespective of religion.
3-        the presence of the Holy Places, and the recognition by Islam of the centrality of Jerusalem, Bethlehem and Nazareth to Christianity. This recognition is best crystallised in Caliph 'Umar's "al-Uhda al-'Umariyya" which was his guarantee of the safety of Christians and their holy places in 638 wen Islam entered the country.5
4-        the urban nature of the Christian population and its living in religiously mixed Christian-Moslem neighborhoods, thus emphasizing openness and neighborly relations. In those instances where Christians lived in villages and rural areas, relations were always characterized by friendly co-operation and communal sharing.
5-        Christians take equal pride in their national and religious roots. Being a good Christian has never detracted from being a good Palestinian nationalist, and vice-versa.
6-        the Ottoman Miller system which recognized the autonomy of the Christian communities to run their own internal affairs, especially those related to religious and civil matters.
․ Palestinian Christians more prone than the rest of the population, to take the difficult decision of leaving.Why?
1-        There is clearly a relationship between the higher rates of departures and the overall bad or worsening economic and political situation during particular years.
2-        The process of emigration for whole families starts when one of the children goes abroad to study, marry and/or work and eventually pulls the whole family to him/her.
3-        Those religious communities with higher percentage of household members abroad are more likely to have their members exhibit intention to emigrate than those communities with lower percentages. A closer look at the religious communities with high a percentage of immediate family members abroad reveals the following percentages in descending order: Armenian Orthodox 61%; Syriac Orthodox 50%; Greek Orthodox 32%; Latins 28%; Moslems 23%; Greek Catholics 15%; and Protestants 8%.

3-        Campaign and advocate as a Christian Society to protect the Christian Holy Sites in Jerusalem and Bethlehem and the Rest of the West Bank. We are the Holiest spot on this earth and something major should be done by the Christians around the world.
4-        Work truly and genuinely for World peace through peace in Palestine. Palestine religiously is the center and having peace there will lead the way to world peace.
